2. Scope
These Terms govern the purchase and use of the digital products offered on the Site, consisting of Excel workbooks, PDF guides and related technical documentation, intended for engineering, techno-economic assessment and financial analysis in the renewable energy sector.
By placing an order, the user confirms having read and accepted these Terms in full.
3. Nature of the products and intended users
The products are preliminary calculation and decision-support tools, intended for professional use by persons with the technical competence required to interpret their outputs.
The products do not constitute:
-
detailed design, a final bill of quantities, or any document certified by a licensed professional;
-
engineering, financial, tax or legal advice;
-
investment advice or a recommendation under applicable regulation.
Outputs depend entirely on the data and assumptions entered by the user and must be verified by a qualified professional before any investment, procurement, design or tender decision.
4. Prices and payment
Prices shown on the Site are stated in the indicated currency and are exclusive of applicable taxes, which are calculated and added at checkout based on the buyer’s country.
Payments are processed by Creem, acting as merchant of record for the transaction. Creem is therefore responsible for collecting and remitting VAT and other applicable indirect taxes and issues the corresponding tax documentation to the buyer. In addition to these Terms, Creem’s terms of service apply to the transaction.
5. Delivery
Products are digital and delivered electronically. Upon successful payment, the user receives a download link by email together with any access credentials required for the files.
Delivery is deemed complete when the download link is made available. No physical media are shipped.
The user is responsible for providing a valid email address and for checking their spam folder. If the email is not received, the user may contact support at the address in clause 1.
6. Right of withdrawal
Consumers (natural persons acting outside their trade, business or profession).
Under EU distance selling rules, consumers have a fourteen-day right of withdrawal. However, as these are digital products supplied on a non-tangible medium, the right of withdrawal is lost once performance has begun, provided the user has given prior express consent and acknowledged the resulting loss of that right.
By completing the order and accessing the download, the user:

expressly requests that performance begin before the withdrawal period expires;

acknowledges losing the right of withdrawal as a result.
Business buyers. The right of withdrawal does not apply to purchases made in the course of a trade, business or profession.
7. Refund policy
Outside the withdrawal cases in clause 6, refunds are granted where:
-
the file is corrupted or cannot be opened, and the issue cannot be resolved by replacing the file within a reasonable time;
-
the product materially differs from its description on the sales page;
-
there has been a duplicate charge or transaction error.
Refunds are not granted for: incompatibility with software versions not listed as supported, absence of functionality never advertised, dissatisfaction with results produced from user-entered data, or purchases made in error after download has occurred.
Requests must be sent to the support address within fourteen days of purchase, quoting the order number and describing the issue. Approved refunds are processed by Creem to the original payment method.
8. Licence and intellectual property
All products — including workbook structure, formulas, methodologies, databases, text and graphics — are protected by copyright and remain the exclusive property of the Provider. Purchase does not transfer ownership; it grants a licence to use.
Permitted:
-
using the product for the buyer’s own projects or those of their organisation, including work performed for clients;
-
modifying and adapting the file for the buyer’s operational needs;
-
including generated outputs in reports, proposals and professional documents.
Not permitted:
-
reselling, transferring, distributing, sharing or publishing the file, in whole or in part, in original or modified form;
-
making the product available to third parties outside the buyer’s organisation, including free of charge;
-
removing sheet protection, copyright notices or references to the Provider;
-
using the methodologies, databases or calculation structures to develop competing products for commercial distribution.
The licence is granted per purchasing organisation, is non-transferable and perpetual, subject to revocation in case of breach of these Terms.
9. Limitation of liability
The Provider supplies the products “as is”, having applied due care in their preparation and verification, but does not warrant that they are free from errors or fit for the user’s specific purpose.
To the extent permitted by law, the Provider is not liable for any direct or indirect damages, economic loss, loss of profit or prejudice arising from decisions taken on the basis of the products’ outputs. In any event, the Provider’s liability shall not exceed the amount actually paid by the user for the product.
Any reference values, cost benchmarks and market parameters contained in the products are indicative and must be validated against current quotations and data before any contractual use.
Nothing in these Terms limits liability for wilful misconduct or gross negligence, nor any mandatory consumer rights under applicable law.
10. Product updates and support
Corrections and updates released within twelve months of purchase are provided free of charge to buyers, who are notified at the email address given at checkout.
Support is provided by email and covers clarifications on product use and resolution of malfunctions. It does not cover technical consultancy on specific projects, customisation or training, which may be the subject of a separate agreement.
11. Changes to these Terms
The Provider may amend these Terms. Amendments apply to orders placed after their publication. The version applicable to a purchase is the one in force on the order date.
12. Governing law and jurisdiction
These Terms are governed by Italian law. For disputes with business buyers, the courts of Cassino (FR) have exclusive jurisdiction. For consumers, the mandatory jurisdiction of their place of residence or domicile remains unaffected.
